3 denial on mental

Gotta say this one was FAST submitted April 30, c&p exam this last Tue and uploaded denial letter today but dates for Monday.

Seems like a prior exam is carrying more weight then IMO and if my most recent exam was favorable, I asked my VSO. To see what it said. Only things I have not submitted and my VSO said I should be good without since I have multiple statements/buddy letter is the stressors form. So I could so suplimental with that or HLR. What’s your advice? Sorry it’s a copy paste or decision so it looks like a lot on mobile.

Service connection for anxiety and depression. A claimant may file a supplemental claim by submitting or identifying new and relevant evidence. New evidence is evidence not previously part of the actual record before agency adjudicators. Relevant evidence means evidence that tends to prove or disprove a matter at issue in a claim. (38 CFR 3.2501) In support of your claim, new and relevant evidence has been received and your claim is now reconsidered. The evidence does not support a change in our prior decision. Therefore, service connection for anxiety and depression remains denied. There is no basis in the available evidence of record to establish service connection for anxiety and depression. This condition did not happen in military service, nor was it aggravated or caused by service. (38 CFR 3.303, 38 CFR 3.304, 38 CFR 3.306) Service connection may be granted for a disability which began in military service or was caused by some event or experience in service. (38 CFR 3.303) Service connection for anxiety and depression is denied since this condition neither occurred in nor was caused by service. (38 CFR 3.303, 38 CFR 3.304) The previous rating decision dated November 7, 2024, denied service connection for anxiety and depression because the evidence did not show this condition was incurred in or caused by your active duty service. The decision is considered final and may only be reopened with new and relevant evidence. (38 CFR 3.2500) Treatment records submitted in connection with the current claim does not constitute relevant evidence because it does not prove or disprove a matter at issue within your claim. These records do not show that your current anxiety and depression is related to your active duty service. In your VA medical opinion dated February 25, 2026, the examiner opined: The claimed condition, which clearly and which clearly and unmistakably existed prior to service, was clearly and unmistakably not aggravated beyond its natural progression during service by an in-service in-service injury, event, or illness. Rationale is without detailed mental health treatment records that document treatment prior to service, it would be mere speculation to opine on aggravation. A direct grant of service connection requires: 1) medical evidence of a current disability,

evidence of the incurrence or aggravation of a disease or injury in active military service, and 3) medical evidence of a nexus (link) between the current disability and the in-service disease or injury. (38 CFR 3.303, 38 CFR 3.304) Your service treatment records do not contain complaints, treatment, or diagnosis for this condition. The evidence does not show an event, disease or injury in service. (38 CFR 3.303, 38 CFR 3.304) We did not find a link between your medical condition and military service. (38 CFR 3.303) The evidence does not show an event, disease or injury in service. (38 CFR 3.303, 38 CFR 3.304) The VA medical opinion found no link between your diagnosed medical condition and military service. Favorable Findings identified in this decision: Your service treatment records report a history of anxiety. Participation in a toxic exposure risk activity is conceded. Your military records dated January 2023 show you served in Southwest Asia. You have been diagnosed with a disability. Your VA examination dated January 20, 2026 shows a diagnosis of generalized anxiety disorder with panic attack and major depressive disorder, recurrent, moderate.
