Tentative Ruling?
So, I've read the tentative ruling in favor of denims and most of it is honestly over my head, one glaring issue stands out to me and is blowing my mind.
The biggest part of Ethan's argument was Denims' direct quote "If you enjoyed watching me and not giving him any views, throw a sub" and this was not mentioned ANYWHERE in this entire ruling. How is that possible? How can the judge just ignore ethans strongest argument?
The judge claims that 3 of the 4 factors of copyright favor denims.
According to the document, in a judgement of pleadings, the court has to take all the plaintiffs' claims as factual, which is the reasoning given for denying market impact as they stated she had the opposite intent politically of Ethan. What is going on here?
