Crating for cognitive decline

We have a 13 year old basset who has been picture perfect healthy until recently. Incontinence and pacing and howling at night for hours even when needs are met. Come to find out he’s been sundowning. Tonight I decided that it might be best to start getting him used to a crate so I gave him food and water, walked him, and gave him a treat and a soft blanket. Within 30 minutes, my bil (lives with us) texts my husband that it’s inhumane and cruel that I’m doing this because “he just pees”. I literally have not stopped crying. I love this dog and am just trying to make everyone comfortable. We were losing sleep, he was walking around and slipping in his own piss, he was scared and wandering around and not sleeping. Am I doing the right thing? He is out and about and plays outside with my children otherwise throughout the entire day. I just wanted to try this for when he sleeps.
