Dismissal before surgery
Because I am ignorant of what specifically is allowed in this community I am keeping this short and sweet and everything in this is fictional.
This is to ask what you would look for in a contract in this hypothetical situation.
Bob is 19 years old and works for a landscaping company for 8 months, works hard and achieves bonus for 5 of those months due to earning above the expected profits for a charge hand. Hours are 37.5 a week and Bob hits his hours and above for 80% of his time there and the times he does not hit hours is for health checkups/sickdays/lack of work. Bob made it clear in his initial interview that he had surgery that would put him out of work for 12 weeks from 12/06/26 and was promised work painting when capable of moving. On the 22/05/26 he was given a letter of dismissal stating
"Dear Bob,
I am writing to let you know that your employment with the company is not working out and will be terminated today with 1 weeks paid notice.
You will be paid 1 weeks pay in lieu of notice and any outstanding monies for works done."
Bob asks what the reason for dismissal is and is told it is just not working out, Bob then asks if its because he is having surgery in the coming weeks that will put him out of work and is told its just not working out.
Bob is less concerned about the money and more so feels wrong done and wishes to know if it was legal and if so would it be stated in the contract.
