DHS final rule update: Is Day 1 CPT going away? Not exactly.
The real story is not that “Day 1 CPT is canceled.”
DHS has moved a final rule to OMB review that may replace the current F-1 “Duration of Status” system with a fixed I-94 end date. This could mean students may need to file an extension if their program or stay goes beyond the allowed period.
The biggest concern for Day 1 CPT students is the possible restriction on repeating the same education level. For example, if someone already completed a master’s degree, starting another master’s program for Day 1 CPT may become harder after the rule takes effect.
So the actual takeaway is:
Day 1 CPT may still exist, but the second master’s pathway may become more limited.
Students who are depending on Day 1 CPT after OPT or H-1B lottery results should not panic, but they should review their timeline, school transfer, I-20, and CPT plan carefully before making any decision.
This is still about timing and eligibility, not a complete ban on Day 1 CPT.
