Tenants refusing to vacate despite lease termination clause and becoming unresponsive — legal options in India?

Need legal advice regarding tenants refusing to vacate property in India.

My parents (both senior citizens) leased out their house to two brothers about a year ago. The lease agreement is fairly standard and includes:

  • Tenants pay one full year’s rent in advance
  • If continuing after the first year, the next year’s advance rent must be paid 2 months before lease expiry
  • Either party can terminate by giving 1 month notice

The first lease year ends in June 2026.

Before the tenants transferred rent for another year, my father had already verbally informed them that we would not be continuing the lease after the current term. Despite that, they transferred another full year’s rent in advance last month.

Since then:

  • They have become unresponsive to calls/messages
  • They are not cooperating regarding vacating timelines
  • During the last in-person interaction, they came across as slightly intimidating/aggressive
  • Because my parents are senior citizens, I have advised them not to meet the tenants alone anymore

We want to handle this amicably and legally, without escalation if possible.

Questions:

  1. Since the agreement allows termination with 1 month notice, what is the correct legal process now?
  2. Should we immediately send a formal legal notice through a lawyer?
  3. Does the fact that they transferred another year’s rent create any legal complications even though they were verbally told the lease would not continue?
  4. Since my parents are senior citizens, are there any faster legal remedies/protections available in India?
  5. Any precautions we should take given the tenants are becoming unresponsive and slightly intimidating?

Would appreciate guidance from anyone familiar with Indian property/tenant law.
