Should I Just Stop Fighting?
The short version:
ITF went in Jan of ‘25 first time making a claim. Effective date for that claim was Feb 10 2025. Almost all conditions were denied for service connection. Filed supplemental with statements and more evidence everything was granted 100% P&T but backdated to the supplemental date and not the ITF (supplemental was within one year for original denial).
My best guess is original C&P exam indicated no CPAP machine (even though I use one and told them that it was broken) resulting in 0% for sleep apnea from ITF date and 50% from the 2nd exam and claim date.
This resulted in a back pay shortage of almost 20k. I tried a supplemental to get the date changed because the examiner did not correctly indicate CPAP usage. And today that was denied.
It’s been 18 months of fighting but by all rules and regulations I should be entitled to the back pay.
What should I do?
