Third, there is uncertainty as to whether all Abuse Claimants with Allowed Abuse Claims will receive their distributions in 2026 due to timing delays that have occurred with respect to certain Claimants. For example, there are over 300 Expedited Distribution Claimants who have been advised (through counsel or otherwise) that their distribution is available as soon as they return a signed release in accordance with the terms of the TDP. We have been awaiting the releases from these Claimants for over a year. In many instances, we have been advised that counsel cannot find the Claimant - whether the Abuse Claimant has become homeless or has simply lost touch with their counsel. For Abuse Claimants in these circumstances, and others, it can take time to locate them and to obtain the documentation necessary to make a distribution. Accordingly, the Trustee instructed PwC to model both the 5.7% Payment Percentage scenario and the 4.7% Payment Percentage scenario under two different assumptions: in one assumption 100% of all currently filed Expedited, IRO, and Matrix distributions are made in 2026; and in the other scenario, 90% of all currently filed Expedited, IRO, and Matrix distributions are made in 2026, with the remaining distributions in the following four years
