Hi everyone,

I’m trying to complete the Amazon KDP tax interview and I’m confused about which tax form applies to me.

My situation:

• Spanish citizen (from Spain, Europe)
• Living in Houston, Texas
• L2 visa holder
• I have a valid SSN
• I’m planning to sell low-content through Amazon KDP
• I’m not using an LLC yet; this would be under my personal name
• I physically live in the U.S., so I may meet the Substantial Presence Test

Amazon’s tax interview seems to point toward W-8 forms, but I’m not sure whether that makes sense in my case.

My question is:

If I am a resident alien for U.S. tax purposes under the Substantial Presence Test, should I complete Amazon KDP as a U.S. person using Form W-9 instead of W-8BEN or W-8ECI?

And if I do not yet meet the Substantial Presence Test,
