Stressed about adjustment of status
I am looking for some reassurance and advice regarding a marriage-based adjustment of status case.
My husband and I got married in August 2025. We have been delaying filing our I-130/I-485 package due to financial reasons and some personal circumstances, but we are now preparing to file.
Here is our situation:
Married in August 2025
We have a joint lease
We have a joint bank account
We have many photos together with family and friends
I have not changed my last name
We have not filed taxes jointly yet because we have not been married through a tax filing season
I was previously on H-1B status through September 2025
After that, I remained in the U.S. and am currently out of status
I have been reading about recent immigration policy changes and enforcement memos, and I am feeling very anxious about whether I should still proceed with adjustment of status.
My main questions are:
For those who adjusted status through marriage after overstaying, how did your case go?
Is a joint lease, joint bank account, photos, and evidence of living together generally considered a reasonable starting point for a bona fide marriage case?
Has anyone filed recently in a similar situation and successfully received their green card?
Are there any additional pieces of evidence that you would recommend gathering before filing?
