(England). I’m defending a £9k claim from a private school (fees dispute). The principle itself (the disputed invoice) is only £6.5k.

Their solicitor sent me a letter trying to add (up to) £10k in legal costs based on an indemnity clause in the t&c that says they can recover “all costs reasonably incurred”.

Case is on the small claims track. I’m defending the entire claim.

Their Particulars of Claim set out specific amounts for everything else but the indemnity costs aren’t clearly quantified at all.

Do courts actually allow this kind of clause to bypass the usual small claims costs limits?
