
EB1C green card category abuse
Recently, all the discussion is about H1B visas that the elephant in the room -L1 visas are not addressed. L1 visas don’t have any salary requirements and are also uncapped. Especially the L1A visa which leads to EB1C (Multinational manager)
The EB-1 program was designed to fast-track green cards for individuals with extraordinary ability, outstanding researchers, and multinational executives who bring exceptional value to the U.S. economy and innovation ecosystem.
In recent years, many applicants have criticized the explosive growth of EB-1C filings from the country that uses majority of visas, arguing that large corporations are using loosely defined “managerial” roles to flood the category, contributing heavily to EB-1 India retrogression and longer waits for genuine researchers and high-impact talent. This abuse affects applicants from other countries and lets in people with questionable credentials to permanently immigrate to the US thus needing the highest attention more than any other categories.
Cumulative approvals of i-140 for EB1-India from 2014 to 2025:
EB1-A: 17,638. || Avg: 1603/yr
EB1-B: 14,193 || Avg: 1290/yr
EB1-C: 59,874 || Avg: 5442/yr ..
This is only i-140 approvals. Total i-485s including dependents could be as high as 150,000 green cards for EB1C alone!
EB1C doesn’t have PERM nor does it have any salary constraints, wait times often hiding behind EB1 umbrella.
Essentially people who are at best contractors who make less than $70k often times are filed under EB1C to get them green cards. A lot of applicants through their employers (you know who) fake documentation to show managerial duties to get EB1C approved. The reason I’m bringing this to your attention is genuine EB1 outstanding researchers and professors have to wait years because of this abuse and some of these are exceptionally qualified, funded by US government to contribute in cutting edge research. I think EB1C abuse needs to be discussed more in X and other platforms like how H1Bs are discussed.
I sincerely request people here to raise awareness about EB1C abuse on social platforms like X. Request data about approved EB1C petitions from the last several years so everyone can see what’s going on.
