Seller’s Lawyer failed to acknowledge my lawyer’s transfer in time and I am now homeless until Tuesday. Advice?
Summary: My home sale closed at 1:00 p.m. on Friday. At approximately 3:00 p.m., my lawyer advised that the proceeds from the sale of my home had been sent to the seller’s lawyer for my new purchase, but the seller’s lawyer never acknowledged receipt. The seller’s lawyer then became unreachable. By 6:00 p.m., I still could not access the property or unload my U-Haul. Because it is now a long weekend, the banks are closed for three days.
Context: I am a single mother with two young children and pets. I have been told I may not gain access to my new home until Tuesday.
As a result, I now need to extend my U-Haul rental for three additional nights. My chest freezer and refrigerator contents are spoiled. My houseplants are deteriorating, and my pet food is packed inside the U-Haul. My work clothes and my children’s school clothes are also inaccessible. I am scheduled to work on Tuesday and cannot take the day off.
My agreement stated that I would have possession and access to the property by 6:00 p.m. on Friday (yesterday).
Do I have grounds to seek compensation for these losses and expenses?
