Possible Constructive Dismissal
I am in England and have worked for a national transport company for 6 years.
In September 2025 I suffered a workplace injury. I completed and submitted an accident form at the time, the company later claimed the form was lost and have questioned if I submitted one but I have evidence of submission as I photographed the accident register entry showing the form reference, my name and the submission date.
In January 2026 I was told by management to stay home until the results of an occupational health assessment were received. Occupational health concluded that I was fit for my role with lifting limitations. 3 weeks later I had an occupational health results meeting with management where they told me they would terminate my contract on ill-health grounds if I didn't get them an operation date within a week (for context I am still on the waiting list now so this was an impossible task) they used a personal risk assessment completed in my absence as the foundation of this, I have now been told this was only a first draft and should not have been used.
I was then advised by the manager in that meeting to obtain a GP sick note because I required surgery related to the injury. So I was threatened with ill health termination before even being medically signed off by a GP.
While signed off sick, I was asked to attend a catch-up meeting with the new engineering director so he could understand everything, this was in March. During that meeting I was repeatedly offered an enhanced financial package to leave the company, which I repeatedly declined. This is an engineering director 1 month into his role offering me an enhanced pay off, it doesn't seem like something someone 1 month into their role would be able to organise or be approved for.
I returned to work last month after my sick note expired because the company had not stated I was medically unfit for work and when asking them if they had a reason for me to still be off they told me to return.
Before returning, I was told several health and safety issues would be addressed. Since returning, I have repeatedly emailed the engineering director about those same issues, including concerns about unsafe equipment, but my emails have largely been met with petty arguments about housekeeping and my issues ignored. He instead carried out a workplace inspection focusing on comparatively minor issues and has told me not to contact him directly from now on.
I now feel that my safety concerns are being disregarded and that I may be being pushed out of the company following the injury.
Does this potentially amount to constructive dismissal, disability discrimination or retaliation for raising health and safety concerns?
I have proof of all of this via email except for the pay off offer but I had a witness present for that who remembers it clearly.
I'm wondering if I just leave, have never had an injury at work before and I have never been treated like this or made to feel like this.
