Awhile back my homeowners insurance company had me write a letter to the town and my neighbor regarding 4 60+ foot pine trees along the property line(trees on neighbor's property) stating they're a hazard should they fall on my garage or house. Neighbor got mad stating they don't have the funds to have them removed. Fast forward to now. Im looking to have my driveway redone and roots from said trees( some 6+ inches) in diameter travel under my driveway onto my property. To have the driveway graded properly these roots will need to be cut. If I have the work done and they cut said roots and eventually these trees happen to fall over damaging my house or garage who is at fault for repairs? One is already dying because roots were cut when they had a new septic tank put in.
