Employment law advice needed - HR aware of my DUI almost two years ago
In December 2024, I was arrested for a DUI and immediately told my supervisor at work, as a clean driving record is necessary to my role. My supervisor never disclosed this to HR, however I was never convicted or plead guilty to the dui. I also never got my license suspended because of it. I was accepted into ARD, a diversion program which will wipe this from my criminal record. I also have no prior issues at work — was never put on a PIP, etc. Today, almost 2 years after the dui arrest, (when they are supposed to do background checks every year) HR emailed my supervisor without my knowledge or myself being included stating I cannot drive for work. My supervisor has been updating me with any further information from HR, but I’m worried I may be terminated as driving (I think) is essential to my role there. Any advice or action I can take, as an employee regarding this situation would be greatly appreciated.
