Can I sue penndot for my car getting towed?
Hi all,
So I’m from PA, I was involved in an accident is Harrisburg that left my car, probably not safe to drive. My friend came and got me, and started to arrange a AAA tow since he had the top of the line towing when the official PennDot towing company showed up. I came over and said I had a tow arranged. He said that was fine and I guess just came out and started looking at my car and whatnot for some reason even though I wasn’t planning on using his service. I asked him if it was suggested I pull off the exit since I was right near one. He said i was fine on the shoulder. I told him I wasn’t sure when the tow would be coming and asked if I should put something in the window to mark it not as abandoned (that’s what you do in PA with a flag or shirt or something, idk if it’s the same for other states) he told me NO, that you only do that if it WAS abandoned. I had my friend there too so she was witness to this. I asked multiple times and he still said no to not put one in if it was abandoned. I said okay. He said i was allowed to stay there for 48 hours and I said okay. After that we left. Today I arranged a tow with AAA and they said it wasn’t there. I called the Harrisburg non emergency number and he confirmed it also was towed. I asked if I put a cloth in the window to signify if it was abandoned and he said yes. Can I sue PennDot for the towing and impound lot fees? I have the name of the man. I really can’t afford these fees right now.
