I have asked our Property Manager to do a basic screen tenants and triage before showing them through the property, mostly due to lack of parking. I'm thinking ask about pets, ask how cars (only 2 parking spaces), that type of thing. The PM has stated "under the Residential Tenancies Act 1986 we are limited in what information we can request from prospective tenants prior to them viewing a property. Before a viewing takes place, we are only permitted to request basic contact details such as a name, phone number, and email address. As a result, we are unable to fully screen or triage prospective tenants prior to attendance". I rang tenancy services and they had no clue about it. I talked to a friend who's a former litigation lawyer and said it sounds like bollocks, firstly that the RTA has no relevance, the HRA and Privacy Act might be relevant if asking for information like race, religion etc. Any idea if the PM or lawyer is correct?
