How legal would a student shooting a school shooter be?
Location: New York, USA
I chose New York, as it has one of the strictest gun laws in the country. This will take place in a high school, and all the students are underage, specifically 16.
In this scenerio, lets say there is a school shooter named “Shooty.” He is Mentally ill, angry, and wants revange.
The student who shoots the shooter will be named Greg.
Shooty comes into the classroom Greg is in, pointing his gun around and saying he will kill everyone there.
But before he can shoot, Greg quickly goes into his backpack, takes out a gun, and kills Shooty before he can hurt anyone. Then, he puts his gun on the ground and raises his hands up until cops arrive.
Greg has been bringing his gun secretly to school for months on end, having aquired one illegally, having discreetly buyed it on a black market. When questioned, he says he only brings it for self defense and no other purposes. He is described as a normal and friendly person by his classmates, is mentally healthy, and his record is perfectly clean except for this moment and when he secretly got his gun.
My question is: What would happen to Greg in this scenario? What legal consequences would he face?
Because on one hand, he saved who knows how many people from being killed. But on the other hand, he has not only been hiding the fact that he carried a gun to school for months, but has also gotten it illegally as he is underage. Does his good deed outweigh his other crimes, or would be still be punished harshly despite it?
