Landlord in Gurgaon deducting ₹26k from deposit for "AC Gas" and "Extra Rent" despite evidence. Need legal advice.
Hi everyone, I recently moved out of my flat in Gurgaon and just received this deduction sheet from my landlord. They have deducted a massive chunk of our security deposit, and I feel many of these charges are illegal/unfair.
The main issues:
3 Days Extra Rent (₹6,450): We moved out early and have written evidence (WhatsApp/Email) that we requested a 2-day extension but actually handed over keys before the 3rd of May. They are charging us for the 3rd anyway.
AC Gas (₹4,400): Our lease agreement says we are responsible for "AC Service" and "Cleaning," but it says nothing about AC Gas. Gas leaks/refills are typically the owner's maintenance responsibility, but they are charging us for it.
Double Cleaning Charges: They charged ₹1,000 for "Kitchen Cleaning" and another ₹3,500 for "House Cleaning."
Washing Machine Repair (₹4,700): They claim "overload" caused damage but haven't provided a professional technician's report or a GST invoice.
Questions:
Since the lease doesn't mention "AC Gas," is this a valid deduction in Haryana?
How can I escalate this to the Gurgaon Rent Authority or Consumer Court?
Has anyone successfully fought a Gurgaon landlord for deposit recovery?
Would appreciate any advice on how to draft a legal notice or which authority to visit in Shivaji Nagar. Thanks!
