At-fault driver refuses to give insurance after giving fake one

Location: TX

My car was hit a couple weeks ago while parked. I was at the store right in front when it happened so I saw it happen and went outside immediately. I got his drivers license, phone number, pics of the scene, and his insurance policy.

I submitted the claim but after some time, their insurance got back to me saying the insurance was not for the same vehicle that hit me but they did find he had an active policy for that vehicle with a different insurance.

He does not want to give me the insurance claiming the vehicle is someone else’s and they do not want to give that information up.

I’ve talked to my insurance but because they may have insurance it won’t count as an uninsured motorist claim. And if it doesn’t they won’t take up the claim. Meaning they won’t cover any damage.

What’s the best course of action here?

Edit: I do have collision but my agent is saying if it’s under the collision deductible, they will “drop” the claim and not pursue subrogation. My deductible is $2000. I really don’t want to be out that amount.

I have called my local court and they said they can’t provide any information on him. They advised me to sue him.
