My wife and I are buying a home. We viewed the house back in March, put in a contract offer, had the inspection, yada yada yada.
Here is the issue;
We just had out final walkthrough this weekend and ran into one of the neighbors. Had a pleasant long conversation with them where they talked about property lines and history with the home and casually pointed out where the septic field was.
This was new information to us. We were never informed that the property was on septic. This listing as well has the property listed as city-sewers.
What is our recourse here? Was this negligence by the listing agency? We still want the home and have contacted the city and they have actually already surveyed the street for sewer infrastructure. So we know that at some point in the near-ish future the option to connect will be available. But it still leaves the question of how the mistake in the listing happened and what fair action looks like.
Any thoughts?
Adding; we are not concerned with the house being septic if an inspection turns up that it is all fine and operating smoothly. So it is not a point of backing out for us.
EDIT/UPDATE;
This was an oversight on the listing agent. Presence of septic was known by the seller. Seller is covering the cost of the inspection and we have obtained records from the tank install company. Closing pushed a day. Thanks for the input. Of note, seller had the tank fully emptied and inspected in November, we have receipt proof of this as he used same company as the install. So no harm no foul, a simple oversight, and the inspection is for peace of mind.
