We filed Chapter 7 with a lawyer and our 341 meeting is in a few days. Is it possible that after the meeting, we can amend our filing to add an extra debt?
It’s a $2k medical bill that has been sent to collections AFTER we filed. The bill is over a year old and I had applied for the hospital’s own financial assistance, which we had been eligible for at least three other times in the last few years; I had no reason to think we wouldn’t be eligible again as our finances obviously were worse than ever. No idea why but for the last year, I’ve been calling repeatedly to see why they haven’t had a determination and they’ve just kept repeating that it was under review and would move back the billing cycle. Made a call shortly before filing and they said they’d mark it “priority” and I’d know in 8-10 business days. Those weeks passed, we filed, finally I called again last week—they’d sent it to collections! Because we’d filed, the collections agency hasn’t contacted us so we have no idea who is holding the debt or how to get their information.
I know you’ll say to ask our lawyer—he is out of the country! He has been gone for a few weeks, since before I learned the bill was sent to collections, and will be gone over the date of our 341 meeting. (We didn’t know this would be happening til after we’d filed, otherwise we might have postponed it.) He is having a different lawyer attend our 341 with us but hasn’t given us that lawyer’s information.
Will this “new” debt come up in our 341 meeting? Will we be able to add it to the bankruptcy after our lawyer returns in a week or so? Will it delay anything?
