Is this workout good enough?

So for context, last Wednesday I ordered a packet from My Nintendo Store (in Spain) to buy the physical copy of Splatoon 3 + NSO + DLC, all good when buying it. Problem is that Nintendo decided to send the packet via one of the worst posts offices we have (Tipsa), very well known for opening packets from customers, stealing them and/or never sending them.

By tomorrow my packet should arrive, in case it doesn't, should I contact Nintendo and ask for a refund? What should I do if they do the typical stuff of "We are investigating" (which they don't) and refuse to give me my money back? Should I just chargeback?
