Hi all,

I’m looking for advice / shared experiences from anyone who has been in a similar position.

I’m an Australian currently living in Spain with my EU partner. I applied for the EU Family Member Residence Card (EX-19) in December 2025 in Girona. My application is still “en trámite” and has now passed the 3 month mark.

I recently applied for an Autorización de Regreso, but it was denied.

I need to travel to the UK (family reasons), and I’m trying to understand the real risk of leaving Spain and re-entering without the TIE card or return authorisation.

My situation:

- Application submitted and receipt (resguardo) in hand

- Living in Spain with my EU partner

- Over the 90-day Schengen limit (but legally staying due to application)

- No approval yet, no fingerprints yet

- Planning to travel with my EU partner

What I’ve been told so far:

- Entry should be allowed under EU free movement rules if I travel with my partner and show proof (marriage certificate, application receipt, etc.)

- Biggest risk seems to be airline confusion or border officer discretion

- Some people report being fine, others mention secondary checks

My questions:

  1. Has anyone re-entered Spain (or Schengen) in this exact situation?

  2. Were you travelling with your EU spouse/partner?

  3. Did you have any issues with the airline or at border control?

  4. Would you personally take the risk?

Any real experiences (good or bad) would be hugely appreciated — trying to make a sensible call here.
