Can I get my house back?
I was in a relationship for nearly 10 years during that time my mother passed away and I inherited the house that I grew up in, plus lived in throughout various stages of my life. My now ex-fiance and I moved into the house after my mother passed away. There was a reverse mortgage on the home and I was not able to satisfy the mortgage amount rquired. My now ex-fiance told me that he would secure a new mortgage in order for us to keep the property with us/in the family. We do share a child together. I went to forclosure hearings for three years and then the reverse mortgage company ended up sending the home up for auction. I told my Ex-fiance abut the auction pending and that the only way that we could delay the process was for me to file for bankruptcy. Sadly I did. He "finally" secured a mortgage, after signing was complete he proceeded to go behind my back and used the deed to show the post office to only have his mail delivered to the house. Along with changing the electric out of my name and turn on under his name, which he had no need to because he was authorized to make changes to the account. He also didn't tell me that he took me off of the car insurance as well. I was driving around our child with no insurance. He then proceeded to stay in the home with us (our son and I) without divulging any of the changes. Three months after the signing he change the digital door code so that I could not get back into the house when I returned from work. After numerous attempts to contact him via phone and text, I had to contact the police department. they showed up checked my ID and I told the the situation. the came out three separate times on the same day because he wouldn't turn off the alarm system. The told him that he had to have take me to court.
About a week after that I was served with a writ of possession. I was dumb founded, blind sided by it. He allowed me to stay because of our son and I did try to talk to him and figure out what the heck was going on and how could he do such a thing to me. He later got pissed off and called the police on me again except this time he had them enforce the writ of possession and I was not able to return. He kicked both me and our child out of the house. I had nothing, no clothes for either my child or me. No means of getting housing.
I was not able to get any of my belongings that I had inherited from my mother or any of my property. I asked repeatedly to no avail and what I was able to recover on the days I was lucky enough to catch what went on the curb before that trash man came he called the police on me. They told them it was nothing they could do because it was on the curb and anyone could come and get it not just me.
I am simply looking to get what may remain of my families belongings, my small business equipment, and the equity that was supposed to be used towards the mortgage. I mean, who would file bankruptcy, give equity and then agree to move out of their childhood home unless other wise duped into trusting someone that was supposedly "saving the family legacy"?
