Builder refusing medical expenses for critically injured construction worker
Posting on behalf of the family of a construction worker (who also works as the caretaker for the building I rent in Bangalore). Seeking urgent advice on how to legally proceed against the builder.
Incident & Medical Status:
Date of Incident: Monday, August 3, 2026
Details: The worker suffered a 4th-floor fall while on the job. I'm kinda sure he wasn't provided any safety gears.
Injuries: Severe head trauma (fractured skull requiring emergency brain surgery, followed by facial reconstruction) and 10–12 broken ribs.
Current Status: Critical condition, currently admitted in the ICU of a private multi-specialty hospital.
Builder's Current Actions:
The builder paid for the emergency brain surgery and paid for the facial reconstruction surgery after significant initial pushback.
They are now refusing to cover any further ICU or medical costs.
They are actively pressuring the victim’s family to sign release papers, discharge him from the hospital, and take him to his hometown (offering to cover only basic ambulance charges and food).
The Dilemma:
The family cannot afford the mounting ICU bills on their own. I advised them not to sign any documents and threaten legal action against the builder, but the family is terrified that pushing back legally will cause the builder to completely abandon them before any legal resolution occurs.
Questions for the Community:
- What immediate remedies are available to force the builder/contractor to pay the ongoing hospital bills?
- Should an FIR or police complaint be filed immediately, or could that trigger retaliatory delays from the builder regarding hospital payments?
- How can the family protect themselves against signing away their rights under pressure from the builder?
