Hi all! I’m on mobile, so i’m sorry about spelling/grammar in advance.
I spent a great deal of energy since Friday trying to thoroughly understand the defendants’ argument and I kept wanting to ask: “Since the cable is merely a guidance document, can a consular officer just approve the visas anyway?”
I know this is obviously not practical… but it seems to me that most of the governments’ argument relies on the answer to this question being yes. I am far from a lawyer, but this has been itching my brain.
Like, if a consular officer approves an immigrant visa from a pause country and then gets fired… wouldn’t they have grounds for wrongful termination?
