Eligibility for ILR application

Hi everyone,

I would appreciate some advice regarding my Skilled Worker ILR eligibility.

My timeline is as follows:

BRP start date: 2 August 2021
Visa vignette valid from: 16 August 2021
CoS employment start date: 6 September 2021
Entered the UK: 14 September 2021
Started work: 15 September 2021

I have remained on the Skilled Worker route since then with no gaps in permission.

I have calculated my absences by excluding both the departure and return dates, in line with the Home Office guidance. My maximum absence in any rolling 12-month period is 173 days, so I believe I am within the 180-day limit.

My question is:

Would my 5-year qualifying period for ILR start from the visa valid-from date (16 August 2021), or from the date I first entered the UK (14 September 2021)?

Based on my understanding, if the qualifying period starts from 16 August 2021, I believe I would be eligible to apply from 19 July 2026 (28 days before completing five years). Could anyone with experience or knowledge of the current Skilled Worker ILR rules confirm whether this is correct?

Which date should I use to calculate my 5-year qualifying period? If I use the BRP date (2nd August), does my "Earliest Application Date" become 5th July? or is it 28 days prior to my Visa vignette date or entry date? Also, does the delay between my visa grant and my actual entry to the UK count towards the 180-day absence limit?

Question 3: 180-Day Absence Calculation
I am looking for clarity on how the Home Office calculates the "rolling 12-month" absence rule.

  • Is there a specific Excel template or calculator that the community recommends to ensure I haven't exceeded 180 days in any rolling 12-month block?
  • Does the calculation include the day of departure and the day of return?

I am Indian currently on Skilled worker visa in UK and about to get my ILR in couple of moths, my wife already has dependent visa and our kid is born in India and i am planning to get him . As i am planning to get ILR In couple of months and any how i need to change them to ILR dependent visa, I won’t to aviod paying for depndent visa fee and IHS charges twice for my kid therefore i am exploring options to see if i can bring him on tourist visa/Visit Visa to join us here in UK and later i will switch him to dependent visa...Can any one please help me on this
