Hey guys. I'll hit my 1 year mark at my company (non US) this July. I basically built our core proprietary software system from scratch by myself over the last year. My company wants to move me to the US office on an L1-B.
Our internal legal team is pushing back hard. They think 1 year is way too short to prove specialized knowledge and they're worried USCIS will just tell us to hire a local US worker instead.
Is it basically an automatic RFE or denial if we file exactly at 365 days? Also does the fact that I built it so fast actually hurt my case? Some people told me I should just wait until the 18 month mark to file so the tenure looks better.
