NY Multi-Member LLC: Does a Non-Member Spouse Need to Sign an Acknowledgment?

I’m forming a small multi-member LLC in New York with one other person. One member may use personal/marital funds from their spouse toward that member’s startup capital contribution. The spouse will not be a member of the LLC and will not have any ownership, voting, management, profit, distribution, or decision-making rights.

The operating agreement states that non-members do not receive ownership or control rights from funding, gifts, loans, services, equipment use, or other support. It also says spouses/former spouses/heirs/creditors do not become members without approval.

From the LLC’s perspective, is it enough to document the contribution as coming from the member only, or is it generally recommended to also have the spouse sign a short acknowledgment that the funds do not create any LLC ownership/control rights?

I understand this may not prevent any separate marital/equitable distribution claims between the spouses, but I’m mainly asking about protecting the LLC and the other member from future claims that the spouse is an owner, investor, or has control rights.
