Hi everyone, I received a Procedural Fairness Letter (PFL) from IRCC regarding the genuineness of my foreign and Canadian work experience. I have 7 days to respond, so I would really appreciate suggestions from anyone who has dealt with something similar.
- India work experience – Advocate (NOC 41101)
I am licensed to practise law in India and have an Indian Bar licence/enrolment. I practised under a senior advocate for approximately 3 years.
I can provide:
* Bar Association membership/card
* Certificate of Practice from the Bar Council
* Bar enrolment/licence documents
* Employment/reference documents from the advocate I worked under
IRCC’s concern is that my Personal History previously described this work as “Legal Associate,” while the employment/reference documents describe my position as “Advocate.” I was working under the guidance of the advocate but was also enrolled/licensed to practise.
My former employer/advocate is also fully willing to cooperate and provide any clarification, confirmation letter or supporting documents required.
Has anyone dealt with a similar issue involving different job-title wording but substantially the same legal work/duties? What additional evidence would you recommend?
- Canadian work experience – Operations Manager (NOC 70020)
I work for an Amazon Delivery Service Partner (DSP), which is a third-party company contracted by Amazon.
My employer/company is registered in Markham, Ontario, but I physically work at the Amazon delivery station/warehouse in Windsor, Ontario. My employer operates the DSP business from the Windsor Amazon station.
IRCC searched the Markham address on my employment letter and noted that it appears to be residential. They also noticed that my T4 has different employer addresses and that my residential address is in Windsor. Their concern is therefore about the genuineness/location of my Canadian employment.
I can obtain documents showing that:
* The DSP company is contracted with Amazon.
* I physically work from the Amazon station in Windsor.
* My employer/company’s registered/business address is in Markham.
* My duties as Operations Manager are performed at the Windsor Amazon station.
* I have payroll/T4s, pay stubs, schedules/timesheets and other employment records.
My current Canadian employer is also ready to fully assist with the response and provide any confirmation letters, company documents, Amazon/DSP-related proof, work-location confirmation or other supporting evidence IRCC may require.
For anyone who has responded to a similar PFL, what documents would be strongest to establish both jobs and explain these discrepancies?
Both employers are willing to cooperate, so I want to make sure I request the right supporting documents and explanations from them.
Any suggestions, especially from immigration professionals or people who have received a similar PFL, would be greatly appreciated.
