Over 120 Days Post-Interview: WOM?

Hi all,

I think a lot of us are in a similar boat here. But basically, my wife and I filed on January 4th, 2026 and had our AOS interview at the Long Island FO on March 11, 2026 and the I-130 was approved the next day. So from an overall case processing timeline perspective, things moved quickly. But from a post-interview perspective, we are stuck.

My I-485 adjudication is still pending. On the post-interview notice my wife and I were given by the officer, it mentioned to give at least 120 days for a decision to be made. I’m wondering if that means that, with this notice in mind, and after 3 unsuccessful inquiries as well as attempts via EMMA, if there is any risk to filing a WOM now? Instead of sitting on our hands for another 6 months. Or even a letter of intent to file WOM. Just curious to hear this threads thoughts, or whether there is any risk with filing it from the perspective of “overall case timeline” being “only” 7 months?

Additional facts:
- J-1 visa
- No overstay at the time of filing (now in a period of authorized stay)
- No unauthorized work during visa, however unauthorized work occurred post visa expiry
- Brazil nationality
- I-765 untouched since Feb 6, 2026

What Does this Memo Mean for Approved I-130 Cases? Pending I-485 Approval

Hi community. I know a lot of you are also in this same situation. My wife’s I-130 case was approved this March the day after her interview and we were told “everything appears in order” and were also expecting the I-485 approval to come in shortly thereafter. It never came. “Case is Being Actively Reviewed” for 60 days now.

Cut to now, we are freaking out about what this memo means for our case, but are finding it hard to believe that after an interview that occurred back in March, which should have already been adjudicated by now, plus an I-130 approval, that the I-485 would somehow be transferred to consular processing.

The facts:
- wife from Brazil
- wife came on J-1 in March 2024
- we met in August 2024
- dating in September 2024
- married in September 2025
- filed in January 2026
- wife maintained her J-1 status the entire way
- wife has since fallen out of status as we are waiting for adjudication
- applying at the Long Island FO

As told by our lawyer previously, this was an extremely straightforward case. And I’m sure lots of you out there are in the same boat.

Has anyone in a similar situation heard anything from their lawyer? Or are we all still in sort of a wait and see.
