H1B —>H4 CoS pending —> H1b ?

I was on H-1B, laid off in November 2025. Filed an I-539 COS to H4 in December 2025 (within the 60-day grace period) — still pending. Now have a new job offer, and the company is willing to sponsor H-1B, but their counsel won't file until the I-539 is adjudicated.

Anyone been through this? I've seen mentions of people filing H-1B while an I-539 is still pending, or withdrawing the I-539 to move forward — anyone actually done this and can share how it went?
