Filing strategy with ver less time to file H1B in grace period

Hi, looking for some guidance from anyone who has been in a similar situation recently.

I was laid off in June, and my H-1B 60-day grace period ends on August 22. I received a new job offer today, which leaves me with only about a week to get the LCA certified and have the H-1B transfer petition filed before my grace period expires.

Has anyone dealt with such a tight timeline recently? Were you able to get the LCA and H-1B filing done in time, or did you use any alternative/fallback option? Would really appreciate hearing what worked for you.

RFE Details

Hi everyone — looking to see if anyone has been in a similar situation and how they navigated it.

I was laid off on March 13, 2026 and my 60-day grace period ended May 12, 2026. My H1B transfer was timely filed in premium processing on April 30, 2026, before the grace period ended and I’m currently working on receipt notice. I received a RFE on my case and it has been 3 weeks now my lawyer says they still havent received RFE details. Any suggestion how do I escalate or follow-up with USCIS. Unfortunately my I-94 is expiring in a month so I am really concerned.

Timeline:

April 29: H1B transfer filed (premium processing)

April 30: USCIS received case

May 12: Status changed to “Request for Initial Evidence Was Sent”

Still waiting to receive details of the RFE from the attorneys.

H1B Transfer after layoff

Still waiting to receive details of the RFE from the attorneys.

I’m really hoping the RFE gets approved, but trying to understand contingency options. If the H1B were unfortunately denied after the grace period has already ended, what are the realistic next steps? I have the option to file H4 through my spouse — would that still be possible at that stage when am outside of grace period if filed immediately after a denial?

Would really appreciate hearing from anyone who has gone through something similar and what you did. Thanks!
