However, Allianz filed an appeal with the Illinois State Court of Appeals on 5/15/2026 after the Illinois court dismissed their original lawsuit on 5/9/2026. Does the 5th Circuit denial stop this state appeal, not directly but it weighs heavily against them after the state court said Texas is the proper venue. All roads are pointing to Texas. But the longer this charade goes on, the more the Trust burns through cash instead of it going to survivors. Still a step in the right direction...
The 3 insurance carriers that settled are not excess insurance carriers. Those funds will go to the general trust fund not the excess award fund (EAF). These are small carriers so there probably won't be a huge jump in the distribution percentage. But every penny helps!
