HDFC Ergo Insurance harassment

I am facing an absolute nightmare with HDFC ERGO regarding my "my:health Optima Secure" policy. Their internal systems completely glitched out, silently cancelled my health cover without a single notification, and now that I've paid the backlog to reinstate it, their automated billing systems have gone rogue.

I need advice on how to legally escalate this, as my risk cover is currently compromised despite HDFC ERGO having my money. Here is the exact timeline of events:

Phase 1:

March 2026: HDFC ERGO’s backend suffered a "refund loop" error. Because of this internal glitch, they failed to present the monthly e-mandate to my bank for premium collection. I was never alerted.

April – May 2026: The insurer completely failed to send any mandatory statutory notices, SMS, or emails regarding the missed premium or impending policy lapse. I was driving around completely unaware that my health cover was dead.

Early June 2026: I noticed the policy was marked as "Inactive" on the HDFC Here app. When I reached out, they initially sent a boilerplate rejection email, blaming me for non-payment.

Phase 2: Fighting Back & The Forced Admission

Mid-June 2026: Refusing to accept their mistake, I formally escalated the matter via the IRDAI Bima Bharosa portal. I proved that my bank account had sufficient funds and that the mandate was never triggered by them.

June 18, 2026: Caught red-handed by the regulator's portal, HDFC ERGO's grievance cell sent a formal email admitting to "technical constraints" on their end. They agreed to restore my policy and waiting-period continuity benefits if I cleared the 4-month arrears via a manual payment link they generated.

Phase 3: The Ghosting & Rogue Billing Loops

June 19, 2026 (Friday): I immediately paid the required ₹3,647 through the manual link they provided. The money was instantly debited from my bank account.

June 22, 2026 (Monday): After waiting through the weekend for manual reconciliation, the HDFC Here app still showed "Policy Inactive" and "EMI Pending." No payment receipt or text acknowledgment was sent by them. I sent emails to their Chief Grievance Officer (CGO) with proof of payment.

June 24, 2026 (Tuesday): Absolute radio silence from their support team. However, their automated billing system clearly woke up and went completely rogue. Instead of activating my policy, it sent me a fresh automated payment link demanding Extra ₹3,648. To top it off, their broken system just fired another completely uncoordinated text message demanding an additional ₹912 link.

The Current Situation:

HDFC ERGO has officially held my ₹3,647 premium for 5 days now. Their grievance cell and automated billing system are clearly not talking to each other. One hand doesn't know what the other is doing, and as a result, I am currently paying a premium while technically remaining uninsured due to their operational delay.

My Questions for the Community:

Has anyone successfully dealt with an offline reconciliation delay with HDFC ERGO? How long does it usually take for their operations team to manually flip the switch?

Since IRDAI is already looped in, should I wait for them to act, or should I immediately approach the Insurance Ombudsman?

God forbid, if a medical emergency happens today while the app shows "Inactive" but they hold my cleared premium, am I legally protected for cashless claims?
