Resigning during probation - Offer letter doesn't clearly mention my notice period. Need advice.

Hi everyone,

I am currently working at a startup company in Bangalore and I am in my 5th month of a 6-month probation period. I have recently received a better job offer, and my new employer wants me to join on 3rd August.

I am confused about the notice period mentioned in my offer letter.

Here's what it says:

It clearly states that *if the company terminates my employment during probation, they will give me 30 days' notice.*

Later, under the termination section, it says: "You may resign from the service of the Company by giving sixty (60) days notice in writing."

However, it doesn't explicitly mention whether this 60-day notice applies during probation or only after confirmation. Another clause in the same section specifically starts with "post confirmation," which is why I'm unsure whether the resignation clause was intended to apply from day one or only after probation. Have attached the pics from the offer letter.

I am planning to resign on Monday by first informing my Team Lead in person, then sending the formal resignation email and submitting it through the HR portal.

My questions are:

  1. Based on the wording above, how would you interpret the notice period during probation?

  2. Has anyone been in a similar situation where the offer letter was silent or ambiguous about probationary resignation notice?

  3. Should I wait for HR to tell me what notice period they expect, or should I proactively request an early release since I have a fixed joining date?

I would really appreciate hearing from people who've dealt with similar situations, especially HR professionals or anyone familiar with Indian employment contracts.

TL;DR: I am in my 5th month of probation and have accepted a better offer with a joining date of 3rd August. My offer letter gives 30 days' notice if the *company terminates me during probation*, but says employees must give *60 days' notice* when resigning without specifying whether that also applies during probation. Looking for advice on how this is generally interpreted and the best way to handle my resignation and notice period negotiation.

Should I low my hopes?

So this month, I went through four interview rounds with a company that was once considered MAANG-level.

The interviews went really well. First round was taken by the Singapore team and the second round by US team. In fact, they skipped what was supposed to be the third round and asked me to come to the office for the final round instead. The role was for a US-based team, and since the director and the team lead were visiting the India office that week, they wanted to meet me in person.

When I arrived at the office, I noticed around 10 to 12 people in the waiting area. At first, I assumed everyone was there for the final round. Later, I found out that six of them had already been selected and were there to complete some joining formalities. Four others were there for their first interview for the same role, and only two of us, including me, were there for the final round.

After my interview, I was asked to wait while the other final-round candidate was told they would be notified later. Around 10 minutes later, a senior HR representative called me in and said they were delighted to offer me the role.

We discussed the salary, team structure, work timings, and my expected joining date. They also asked if I could negotiate my notice period so I could join as soon as possible. I agreed, and before I left, I asked when I could expect the official offer letter. Since it was already Thursday, HR told me I should receive it by Monday or Tuesday.

Before I left, HR congratulated me and said, "See you in the office soon." As I was walking out, the director also congratulated me on getting the role.

Monday passed without any email, but I wasn't too concerned because HR had mentioned Monday or Tuesday. However, even by Tuesday, I still hadn't received anything. So I sent a short and polite follow-up email. Within 10 minutes, HR replied:

"We appreciate your patience. Please allow us one more week. We'll be back with an update as soon as possible."

Now I'm not sure how to interpret this.

Should I be worried that the verbal offer has been revoked, or is this kind of delay fairly common? I'd really appreciate hearing from any HR professionals or hiring manager regarding this situation.

I was genuinely excited about the opportunity and just wanted to understand what this response might mean.

Thanks to everyone who made it this far. :)

TL;DR: Cleared all interview rounds, received a verbal offer from HR after the final round, completed salary negotiations, and was told I'd receive the written offer by Monday/Tuesday. Instead, HR later asked me to wait another week and said they'll get black with an update Should I be concerned, or is this a normal hiring delay?
