Question

Was declared mmi in May work comp closed my medical and was titled as permanent partial disabled and said we are working on your settlement that was two weeks ago and have not heard a word even after daily emails, I’m growing increasingly frustrated with them as well as my company because I’m still making state minimum wage straightening shelves, my question is can I resign and still get my settlement? Any insight would be helpful and thanks.

I tore my rotator cuff full thickness tear and everything else in there on Oct 24, March of 25 they did my surgery did the pt shots work conditioning and was sent back to work on light duty in august of 25 10 pound weight restriction so the store had me straighten shelves for 8.75 state minimum wage, I am a department manager making 19.58 so that’s was a big drop in pay with the store taking out insurance and taxes most of my checks have been between 40 and 75, wc checks have been sporadic at best would get them every week then wouldn’t get one for 2 or three weeks twice it was a month may of 26 I was declared mmi with a weight restriction of 10 over heard and 15 for lifting pushing pulling etc have not gotten a wc check since and was two weeks behind before the mmi, have left voice mails and emails for my case worker since I got the mmi and haven’t heard back, the store has no idea what to do with me so they continue to have me straighten shelves I’m beyond frustrated with them both.
