H-1B → F-1 Change of Status Approved — Sharing My Experience

Hi everyone, I wanted to share an update on my H-1B to F-1 Change of Status (I-539) journey in case it helps someone going through a similar situation.

I filed my H-1B → F-1 Change of Status on March 31, 2026, while I was within my H-1B grace period. My case later received an RFE, primarily concerning residence abroad, commuting distance, and my program start date/I-20 validity. I submitted a detailed response with supporting documentation.

After several months of waiting, my F-1 Change of Status was finally approved! 🎉

A few things that may be helpful for others:

  • I filed the I-539 while still within my H-1B grace period.
  • My original I-20 start date was deferred, and I obtained an updated I-20 for the Fall 2026 term.
  • I responded to the RFE with detailed documentation addressing each issue raised by USCIS.
  • I did not leave the U.S. while the Change of Status was pending.
  • The case was ultimately approved despite the I-94 expiration occurring while the application was still pending.
  • Ignore the hateful comments on Reddit; they are mostly bots. I suspect that they are ironically from India.

I know there are many people currently waiting on H-1B → F-1 COS cases, dealing with RFEs, deferred I-20s, or uncertainty about maintaining status. I wanted to share my experience because I found other people's timelines and experiences extremely helpful during the process.

The RFE requests:

  • Evidence of residence abroad and intent to return;
  • An explanation of how my extended stay in the U.S. affects my foreign residence;
  • An explanation of why my current U.S. address is outside the commuting distance of my school;
  • A new I-20 with a future program start date.

Brief background:

  • Indian citizen;
  • Filed I-539 in March 2026;
  • Filed for Premium Processing;
  • Current I-94 expires August 9, 2026;
  • Current I-20 start date is September 9, 2026;
  • RFE response deadline is August 13, 2026.

I have an Indian bank account and family/property ties in India. My mother continues to live in India and manages family properties and rental matters.

If you received a similar RFE, I would really appreciate hearing what evidence you submitted, especially for:

  1. Residence abroad; and
  2. Commuting distance.

Did you prepare the response yourself or work with an immigration attorney? If you hired an attorney, would you recommend doing so for this type of RFE? If you handled it yourself, do you have any recommendations based on your experience?

COS H1B to F1 - Premium processing

Hello everyone,

Looking for any recent experiences, timelines, or insights on upgrading a pending online I-539 Change of Status to Premium Processing under my specific circumstances.

Here is my timeline and details:

  • Feb 6, 2026- Last date of employment
  • March 31, 2026- Filed Form I-539 online on March 31, 2026, to change status from H1B to F1.
  • Filed timely within my 60-day H1B grace period (last day of employment was Feb 6, 2026).
  • April 6, 2026--Original I-20 program start date was April 6, 2026. Because the case has been pending, I deferred my admission.
  • Current I-94 -"Admit Until Date" is August 9, 2026.
  • September 9, 2026 - My new deferred I-20 has a program start date of September 9, 2026 (Earliest admission date is August 10, 2026).
  • To date, I have not received a biometrics appointment notification, nor have I attended one.

My plan right now is to upload my new deferred I-20 as "Unsolicited Evidence" via my online myUSCIS portal, and immediately follow it up by filing Form I-907 online to upgrade to Premium Processing ($2,075 fee).

A few questions for anyone who has done this recently or handles these cases:

  1. Premium Processing: Should I immediately file for the Premium Processing?
  2. Biometrics: I know USCIS generally dropped the biometrics fee/requirement for I-539, but does upgrading to Premium Processing prompt them to reuse existing fingerprints automatically? Since I haven't received a biometrics notice yet, will the 30-business-day clock start running immediately upon payment, or am I at risk of them pausing it to mail me a biometrics notice?
  3. Unsolicited Evidence Timeline: Has anyone uploaded a deferred I-20 as unsolicited evidence right before triggering premium processing? Does the adjudicating officer actually review it, or is there a high chance they look at the old April date and send an RFE?
  4. The 30-Day Gap Rule: Is there any risk regarding the gap between my August 9th I-94 expiration and the September 9th start date? My understanding of current USCIS policy is that as long as the initial I-539 was timely filed during my valid grace period, a "bridge application" is no longer required, but I wanted to double-check if anyone has faced pushback on this.
