On May 8, 2005, Kirven and fellow Marine Cpl. Richard Schoener were killed in action after engaging insurgents during a operation in Alishang, Afghanistan.
Nicholas Kirven was awarded the Bronze Star Medal with Valor, the Purple Heart, and was posthumously promoted to the rank of Corporal.
