My mom passed away recently leaving us without a will.

She nor my dad ever made a will.

Me and my elder sister are the only heirs to the house my mom left in Hyderabad Telangana.

The property is in my moms name and my sister has power of attorney & currently occupies the house with her family.

I’m a Canadian citizen but don’t have an OCI card as of yet. There are 2 rental flats on the first floor and 2 incomplete flats on the 2nd floor.Now my sisters husband wants to finish the incomplete flats and build a couple of more flats on the 3rd floor of the property to generate rental income.

I’m worried as my brother in-laws may claim a stake in the property ,but my sister said he will take the rental income until he recuperates the building expenses and won’t hold a stake in it.

I’ve asked my sister that they pay me my portion of the inheritance so that I’m out of the picture but she said they don’t have that much cash and said they will share the rental income until they pay off my inheritance which I’m highly skeptical of. I’m worried that my brother in law will cause conflict when the time comes to selling the property

These are my immediate concerns 

1-How do i go about obtaining legal heir certificate for me & my sister? Can it be done online from Canada?

2-Should i immediately apply for an OCI card to claim inheritance ( as I’ve lost my aadhar card from the time i was Indian)

3- where do i find a reliable broker or builder to give me valuation of the property with the current market trend?

4- what further steps can i take to safe guard the inheritance against my brother in law

5- what kind of lawyers can i consult and get a legal opinion on this?

Really appreciate any help to navigate this situation

Tree advice

our neighbours birch tree branches over hang into our backyard causing a lot of mess So we are looking to remove that portion.

Whitby by law says its the tree owners responsibility to ”maintain“ the tree but they can’t advise regarding arborist costs as thats a civ matter?

looking for advice of this is something the tree owner should pay for since the tree is on their property or do we pay for the pruning after getting their permission?
