Hi.

This statement (below) is written in the additional terms on an Ontario lease. I believe that a tenant does not have to sign a new lease when a fixed term lease (12 months) ends as it just goes to a month to month tenancy. I think the tenant can just say no and there is nothing the landlord can do about it. I believe it to be a violation of Section 4 (1) if I understand it correctly in the RTA.

"The Tenant if not in default here under, shall have the option, by written notice, given to the Landlord at least sixty days before the end of the Lease Term to renew for a further year."

I think the tenant can just no, and provide 60 days notice in writing when they are planning to leave.
