Medical Battery? Vaccination of minor without Parental Consent (US-OH)
Ok I want to preface this to say I am not an anti-vaxer. I believe in vacations and science.
My daughter is under 18, in high school but already taking basic medical courses.
For one of them with clinicals she was required to get a flu vaccine.
My daughter went to a local large chain pharmacy for the flu vaccination and expected to wait for her mother, who was on her way to provide parental consent. Before her mother arrived, they administered the flu vaccine without any parental consent.
According to my daughter, she repeatedly stated that she was under 18, offered to show her identification, and asked whether she needed to sign anything. She did not sign anything. They said they had it "taken care of".
During the visit, staff also repeatedly pressured her to receive an HPV vaccine that had not been requested. She declined and explained that her mother had told her she did not need another HPV vaccination as she had already received one in the past. She said that even after that they continued trying to administer it along side the flu shot saying she was due. Literally bringing them in together to administer. She refused again and ultimately received only the flu vaccine, but still without any parental consent.
My daughter has POTS and was very distressed by the encounter. She has had rashes afterward. She was not kept for a post-vaccination observation period and ended up telling her mother she no longer needed to come because it was already over and they told her she could leave immediately after.
I feel like I'm making a big deal out of this but it's really upset me that this was even able to happen and that they didn't follow what seems like basic expectations... the fact they kept pushing a vaccine she did not need, because she has already had it multiple times, filled the prescription anyway, is absolutely crazy to me. The fact she signed nothing, had zero consent, is even crazier.
I called the pharmacy, recorded the phone call (one-party consent state), and they initially tried to say they had her on camera requesting the HPV vaccine, when I argued against that and told them what actually happened they backtracked hard, said they didn't believe parental consent was required and that they hadn't ever heard that before in their years of experience, and ended up stating on the call that she did indeed receive the flu vaccine, and that this all happened outside of their typical procedure.
Any thoughts overall?
