The Court of Justice of Santa Catarina (TJSC) ruled by a majority to restrict the law and the decree prohibiting the breeding of Pit Bull dogs in the state. The justices deemed unconstitutional the measures preventing the breeding, sale, and circulation of these animals, as well as the provision mandating their neutering.
In a statement, the State Secretariat for the Environment and Green Economy announced it is analyzing the ruling to determine the necessary next steps.
The justices' decision, published on Wednesday (17), concerns two state regulations:
The rapporteur for the decision was Appellate Judge Ricardo da Luz Fontes. In his opinion, he argued that the regulations effectively prevented a professional activity in Santa Catarina. He also highlighted the fact that only Santa Catarina had a law of this nature.
>"The ban on the sale and breeding of these dogs, as well as the mandatory sterilization requirement, goes far beyond—very far beyond—a mere restriction on the freedom to practice a profession. Legislation of this kind effectively puts an end to a professional activity entirely within our state."
---
>"In a country the size of Brazil, banning a commercial activity in just one single state is a clear affront to the federal system. Constituent entities possess autonomy, of course. However, sovereignty—that is, supremacy within the domestic order—belongs to the Federative Republic of Brazil."
Consequently, the Court of Justice ruled Articles 1 and 2 of these regulations unconstitutional.
Other rules regarding public safety set forth in the law and the decree—such as those governing where these dogs may go and how they must be handled—remain in effect:
Those measures would also have applied to pit bull adjacent breeds:
-------
So because these measures would "ban a commercial activity" and were independent from the federal government, they were deemed inconstitutional and will no longer be active. Pit bulls will continue to be bred and sold, and we will continue to live in fear.
For greater context, Santa Catarina and the other two states in the South, Paraná and Rio Grande do Sul all are among the most prosperous, with the highest quality of life and with the least inequality in the country. They are also screwed over by the federal pact. In 2022, Santa Catarina sent R$107 billions to the federal government, and only received R$7,7 billions back. At the same time, its prosperity keeps attracting people from all over the country, with 503.580 people moving to the state between 2017 and 2022.
