Thoughts on TX auto accident lawsuit
Hi all! I’ll preface this by saying both my husband and I work in the industry- my husband is even a bodily injury adjuster, but wanted to post here to gather some opinions. Everything has been turned over to our carrier, I know how the process works, and to not worry too much about actually seeing a courtroom. We were involved in a minor MVA in November of 2024 where the other party was rear ended at under 5MPH (foot taken off of pedal, no gas applied). Injuries seem to be all soft tissue with no lost wages. We were served the other day, but the circumstances feel a little strange. Talking with the adjuster, the attorney has never sent in a demand, bills or records, or even attempted to negotiate. Their office just went straight for the lawsuit with almost no communication with our carrier. The adjusters thoughts are that it’s just the protect the statute of limitations, but those still have a few more months to run (November). My husbands thought is that the firm dropped the ball on handling the case, so a lawsuit has been filed to appease the client. We don’t really have any assets or high paying jobs, so what are your thoughts on the filing of the suit?
