Some context- A roommate and I signed a lease 2 years ago. The summer was brutally hot as we discovered there was no insulation (even though the manager swore it was installed during renos. We sent a pic of no insulation. For over a year they've been swearing it's still in the works, we should know within the next week, it just needs to get approved, I haven't forgotten about this, etc) We stayed an extra year and switched to month to month lease since they hired a new property manager who appeared more competent and swore it was at the top of her list. Needless to say, we're over it an moving. I sent my property manager an email that if that my roommate will be moving and unless insulation is installed soon, I will be too. My roommate emailed his notice a few days later. I did not give notice yet because I hadn't found a place and was playing the waiting game. I've since signed a lease elsewhere and decided to try and be included in him giving notice. Normally I wouldn't do this but they've been absolutely horrible to work with and rarely follow up on our communication and drag us along with lies for months. Additional example of how they operate- squirrels have been in our attic on and off for a year and they made a hole in the ceiling of the stairwell. They've known this whole time and have yet to fix it. Most of our maintenance requests are still not done.
My real question: Is the email I sent last month valid as notice or am I just stuck paying an extra month rent? I know my email didn't have an official moving date but my argument is that my roommate and I are both on the lease so him leaving would change the lease and that I said I would be moving with my roommate if an update wasn't given in a few weeks and no communication was received after that. And would this hold up anywhere?
Additional note: I told my roommate that using the security deposit as rent is not allowed (as he mentioned in his email) so we did pay rent. This follow up email is the first time we've heard from them since before I told them I will be moving if insulation is not fixed.
