Open work permit while waiting for spouse sponsored PR denied (completeness check) question
Hi everyone,
I seldom post on Reddit, but we are quite desperate and don't know what to do. Me and my wife are in a strange situation, and i'd like to know if this has happened to other couples before us. Hopefully we can get perspective and maybe get our questions answered.
I (Canadian citizen) am sponsoring my wife (Mexican citizen) for Permanent Residence. We've received her AOR and we received a letter from ircc stating that I've been approved as a sponsor for her.
While her PR is being processed, she submitted an Open Work Permit application, and it was denied on the grounds that (and I quote) "Client's application for permanent residence has not passed the section R10 completeness check nor has it passed first stage eligibility, therefore not eligible for this type of permit."
After getting the initial refusal in July, we called ircc, and the agent on the phone told us that she (my wife) was indeed eligible for this type of permit, and it must have been an error. She also told us that we had forgotten to include the AOR with the application (it wasn't in the list of documents to include with the application), and so that may have been what triggered the refusal. She was kind, and submitted an appeal on our behalf, instructing us to submit the AOR right away by Web Form. So that's what we did. She also instructed us to resubmit (!) another OWP application and that hopefully, it would be processed before the appeal (we have already waited 8 months for the initial refusal).
Now, a month after the initial refusal, we get an information letter letting us know that they have reviewed our application and find, even with the additionnal submission (the AOR), there are insufficient grounds for reconsideration, meaning the decision remains the same.
So, we are completely lost, as ircc seems to be contradicting themselves, and we do not know who has the right information. Is she eligible for an Open Work permit? And if so, what could be missing and triggering a refusal in her application? We have no new information to add to the new OWP application if we decide to submit one.. will we just get refused again?
If anybody has heard of a similar situation that could let us know how it got resolved would be immensely appreciated.
