Attorney told me not to worry but unfortunately it’s just who I am as a person

This has been the most stressful few months of my life. I am filing separately from my husband. We are under median. The Schedule I/J my attorney created has us about -$500 in the hole based on our current CMI, but my husband’s income varies greatly.

All year he has had no overtime and then right when I get everything filed 3 guys quit. So now he’s working like 20 hours a week more than usual. I have to turn in updated paystubs to the trustee right before the 341, and I have no idea how it’s going to go. He’s making $400-600 more per week. I already stopped paying my creditors so I’m thinking if this gets dismissed I’ll be behind beyond the point of catching up and one card charges off the 31st so I feel like a lawsuit would be imminent.

The OT won’t last but I also can’t say for sure when it’s going to end. This whole process has just been so stressful. I won’t do a chapter 13 because when he doesn’t get overtime we are severely in the hole. His income is way too variable for me to commit to a payment plan.

I just have a bad feeling it’s not going to work out. It’s consuming my life at the moment.

Stressed and depressed - please tell me it gets better

A few weeks ago I had my consult for a chapter 7. I paid all the fees, submitted all my documents, and finished the credit counseling course. The wait is killing me. I haven’t heard anything from my attorney yet. I had 5 consults total and was told due my husband’s overtime we would be right on the line in terms of disposable income. We’re under median either way, but depending on how they calculate everything we might not qualify for a 7.

Our gross income is about $76k for a family of 4 in Indiana. I have high medical costs and all the debt is mine. I haven’t been able to work since 2024 due to health problems.

I just wish I knew if we will qualify or not. I wake up and debt is the first thing I think about. I haven’t been sleeping well. I used to have a good job and never had issues with debt until I got sick. It makes me feel like a burden to my family and overall is just really affecting me mentally.
