Spain’s 183-day tax rule is way more aggressive than most digital nomads think

A lot of people think the “183-day rule” in Spain is simple:

>

But in practice it can get much messier.

Spain’s tax agency may also look at:

  • where your economic activity is centered
  • where your partner/family lives
  • bank activity
  • phone/location records
  • utility usage
  • flight history
  • lifestyle evidence from social media

The recent Shakira case made this topic huge again because the entire dispute basically revolved around tax residency.

What surprises me is how many digital nomads assume:

  • tourist visa = no tax residency
  • moving every few months = impossible to track
  • “I’m paid abroad” = not taxable

That’s often not how EU tax agencies see it.

If you’re living between countries long term, it’s worth understanding how residency tests actually work before problems appear later.

The whole Shakira tax case in Spain basically came down to 183 days

A lot of headlines are saying Spain may have to return around €60M to Shakira, but the most interesting part of the whole case is actually the famous “183-day rule”.

In Spain, if the tax agency believes you spent more than 183 days in the country during a year, you can be considered a tax resident and may have to pay taxes there on most of your worldwide income.

That’s basically what this entire dispute has been about for years.

I made a simple breakdown explaining:

  • how the 183-day rule works
  • how Spain determines tax residency
  • why this matters for celebrities, entrepreneurs and digital nomads
  • how much money was actually at stake

I tried to make it understandable for non-lawyers 😅

I've been working on something that tries to solve a problem I personally had with WordPress:

Most “AI tools” generate content, but they don’t actually DO anything inside your site.

So I built a lightweight plugin that can:

  • install and configure plugins
  • create pages/posts
  • set up basic WooCommerce flows

All from simple instructions like:

“Prepare my site for selling products”

Still very early and rough, but I recorded a quick demo:

Curious — what would you actually want something like this to handle?
